Section 3: Scope of Authority
3.1 DAR Authorized Functions
I, Robert Smythe, am authorized by the Minister of Transport to perform the functions of a DAR in the
functional specialty of Structures (Loads and Airframe Stress). This authorization is granted by the TCCA
letter dated January 10, 1999 which is reproduced in Appendix D, and through the granting of the
Delegation of Authority certificate shown on page iv. I will accomplish the delegated functions in
accordance with the information contained in this EPM and the TCCA letter of authorization.
Within the scope of authorization and subject to the functions, responsibilities and authorizations
identified in this section, I will participate in design approval activities leading to the issuance of
RDC's, LSTC's, and STC's in the capacity of a DAR in the Structures Specialty. My scope of delegation is
applicable to those aeronautical products that are certified to CAR Part V, Subpart 25, or
equivalent, for Transport Category Aeroplanes.
I, Robert Smythe, may perform the airworthiness engineering functions contained in this EPM. The
following privileges may be exercised in the specialty of Structures, subject to limitations defined in the
TCCA letter of authorization seen in Appendix D, and defined in Section 3.2:
- Approval of technical data only in support of making a statement of compliance for the delegated
standards of airworthiness; including:
- engineering reports;
- engineering drawings;
- configuration drawings and instructions;
- drawing lists;
- Instructions for Continued Airworthiness, i.e., against AWM section 525.1529 but not the ICA's
themselves which are accepted (except Airworthiness limitations which are not delegated); and
- other engineering data relating to structural applications;
- Making a recommendation to TCCA using the Statement of Compliance form for non-delegated engineering
data;
- Issuance of RDC and LSTC approval documents; and
- Make a determination that a change to the type design is significant or not-significant in accordance
with subsection 511.13 or paragraph 513.07(3) of the CARs and document that determination using
the Changed Product Rule (CPR) Decision Record form shown in Appendix B of TP 12995.
AMA 500/16, PL 500-002 and the soon to be published SI 500-003 will be used to make this
determination.
The delegated functions and authorized areas for which findings of compliance may be made are identified
in the Functional Matrix and Specialty Delegation Matrix provided in Appendices B and C respectively.
3.2 Limitations
The general limitations identified in chapter 3.5 of the Delegations Handbook for Designated
Engineers and Design Approval Representatives apply to the extent and exercise of my delegated authority.
In addition, the following specific limitations apply:
- Only those delegated functions in the authorized area defined in this EPM and the TCCA letter of
authorization may be exercised;
- The delegated privileges are not transferable and cannot be further delegated;
- Items in the Structures specialty that are not delegated and will require TCCA approval, including:
- Basic loads (except loads whose magnitude is defined in the airworthiness standards such as emergency
landing inertia loads)
- Fatigue and Damage Tolerance Items;
- Flutter and Aeroelastic Methods;
- Discrete Source Damage (such as Bird Impact, Rotor Burst);
- Ditching;
- Airworthiness Certification Test Programs; and
- Composite Material;
- New Airworthiness Requirements and Standards introduced subsequent to the appointment shall be
reviewed with TCCA with respect to their applicability to the delegate's scope of delegation. A new
authorization letter may be required; and
- Required to advise TCCA when the exercise of this delegation requires a failure mode and effects
analysis having a significant impact on Airworthiness. AWM section 525.1309 is not delegated for
essential and critical systems.
3.3 Overlapping Responsibilities
For projects and requirements where a clear division of responsibility is not possible resulting in an
overlap of functions between specialties (e.g. Test Pilot, Flight Analyst, structures, powerplants,
mechanical systems, avionics and electrical systems), I will only be responsible for the Structural aspects
of an approval, i.e.:
- Structures and Powerplant - responsible for the structural aspects of the powerplant installation
only;
- Mechanical, Hydraulic, Avionics and Electrical Systems - responsible for the structural aspects only
of these systems including their installation;
- Flight Test - responsible for the structural aspects only of Flight Test;
- Heating, Ventilation and Pressurization - responsible for the structural aspects only of these
systems;
- Fire Protection - responsible for the structural aspects of the fire protection including possible
fire damage powerplant fires may cause to the other aircraft structures and structural damage by exposure
to the heat of other fires; and
- Miscellaneous Components - responsible for the structural aspects of the fuel tanks.
3.4 Change to Authorization
I acknowledge that TCCA retains the right to either increase, decrease, or remove the level of delegation
granted to me, and that these changes will be in accordance with the guidance in chapter 3.6 of the
Delegations Handbook for Designated Engineers and Design Approval Representatives. Any change to my authorized
scope will result in a revision to this EPM, which will be submitted to TCCA within 20 working days of
receipt of written change notification.
3.5 Duration of Authorization
I understand that this authorization will remain in effect until withdrawn subject to the conditions
in chapter 3.6.4 of the Delegations Handbook for Designated Engineers and Design Approval
Representatives.
