Update on CAR 521

What is CAR521?

On October 14, 2009, Canadian Aviation Regulation (CAR) 521 was introduced and published in the Canada Gazette, Part II and came into effect on December 1, 2009. CAR521 provides the requirements to design, create or modify aeronautical products in Canada and for foreign products to be used in Canada.

The purpose of the new CAR521 is to streamline and simplify the regulatory environment, clarify the responsibilities and accountabilities between the Minister and the holder of Canadian aviation documents, as well as to harmonize Canadian regulations to the greatest extent possible with our major trading partners.

In April 2010, a meeting was held between Transport Canada and the industry to discuss the new CAR521. During this meeting, the industry identified issues associated with the transition from the predecessor regulations to the new CAR521, including four top priority issues to be mitigated:

  • Clarification of the terms “conformity” and “compliance” in the text of the regulation;
  • Clarification of provisions for test flight requirements;
  • Clarification of actions required in the event of a service difficulty report; and
  • Clarification of requirements associated with Canadian Technical Standard Order Design Approvals.
