Failure to comply - Restrictions on permit

The respondent, holder of a student pilot permit was alleged to have flown a Cessna when he was not under supervision or a qualified instructor. The Minister assessed a monetary penalty of $200.00

On review, the respondent or his representative did not appear at the hearing. The testimony of the DOT Inspector was accepted as proof of the contravention of the ANO. The monetary penalty was re-affirmed.

That Alvin P. Bancarz contravened Air Navigation Order, Series IV, Number 1 and 3 and the penalty of $200.00 is upheld.

Since Mr. Alvin P. Bancarz or his representative did not appear at this hearing, and after hearing Mr. Ned Carnie's testimony under oath, I am convinced that Mr. Alvin Bancarz did:

1. Fly his Cessna 150 Aircraft C-FWHG with only a Student Pilot Permit and without the supervision of a qualified instructor.

2. Land on a highway near Innisfree, Alberta without an emergency situation.

I have determined that Mr. Alvin P. Bancarz should pay the $200.00 penalty for the contravention of Air Navigation Order, Series IV, Number 1 and 3.
