Initiation of suspension procedures

Purpose:

To amend the procedures related to the initiation of a Canadian Aviation Document (CAD) suspension by Approved Check Pilots (ACP) or Civil Aviation Safety Inspectors (CASI).

Background

ACPs, as Authorized Persons for licensing purposes, can add temporary privileges to a license.  ACPs however do not have the power to suspend CADs.  ACPs initiate the process to suspend by notifying TC.  Only CASIs hold the authority to suspend CADs by filling out the applicable notice (form 26-0363E or 26-0364F) and immediately serving the notice to the document holder.

Section 5.2 of the ACP Manual lists the procedure to be followed by an ACP or a CASI when the need to suspend existing privileges (namely a Pilot Proficiency Check or an Instrument Rating) arises. This list includes, when the privilege to be suspended is still valid, the long-standing practice of striking out text in the holder’s Aviation Document booklet, annotating a suspension, and signing the entry.

Intended Staff Guidance

Effective immediately, the practice of striking out text in the holder’s Aviation Document booklet and annotating a suspension will be discontinued.  Such an action by an ACP or a CASI has no basis in law since the suspension only takes effect when a notice prepared in accordance with Section 7.1(2) of the Aeronautics Act is being served in accordance with Section 7.1(1) of the same act.  Moreover, such a practice alters the Aviation Document booklet to the point where it may invalidate it. 

Procedures found in Chapter 5 of the ACP Manual that require the ACP to immediately advise the document holder, the air operator associated with that individual and the Issuing Authority office of Transport Canada, will remain in place to ensure that the suspension process is being initiated and that the individual is removed from the air operator’s active roster until re-qualified.  The same procedures will continue to apply to CASIs, with the additional requirement of preparing the applicable notice of suspension and serving it to the document holder. 

Immediate Effect

This instruction takes effect immediately.  The next edition of the ACP Manual will reflect this change.
