PROCEDURAL AGREEMENT

- for VFR free fall/parachuting operations in controlled airspace

THIS AGREEMENT is made as on this the day of , 1998.

BETWEEN:

Nav Canada

a corporation incorporated under the provisions of Part II of the Canada Corporations Act

AND

[Organisation]

WHEREAS Nav Canada is responsible for Air Traffic Services (ATS);

AND WHEREAS [Organisation] is a VFR parachuting operation located at [Location] Airport;

AND WHEREAS both parties wish to coordinate their respective operations;

NOW THEREFORE THIS AGREEMENT WITNESS THAT in consideration of good and valuable consideration (the receipt and sufficiency of which is hereby acknowledged), the parties hereto agree to the following:

Section 1 Purpose:

This agreement is to outline aircraft operational procedures between [Organisation]’s parachute operations, their CVFR aircraft, and the Nav Canada ATS units supplying Air Traffic Services for the airspace affected.

Section 2 Nav Canada covenants:

Nav Canada shall provide Air Traffic Services for aircraft and hazard separation in accordance with the CARS Part VIII and CARS Air Navigation Services Standards 821 - Canadian Domestic Air Traffic Control Separation to minimize the risk to aircraft.

Section 3 [Organisation] covenants:

(A)  [Organisation] shall contact [Location] Tower at the start of every day that there will be parachuting operations for the transponder code to be used and for information required for that day’s operation. [Organisation] shall inform [Location] Tower as to the day’s proposed free fall/parachute descent profile.

(B)  The pilots on the climb to, and descent from, the parachutist’s exit point shall comply with all ATC instructions and clearances.

(C)  For free fall/parachute descents commenced above 5000' ASL [airspace boundary] the pilot shall notify appropriate controller at [Location] ACC and [Location] Tower 2 minutes back from the parachutist’s exit point. If there is no conflicting traffic the ATC units shall acknowledge that there is no conflict. If the ATC Units do not respond, or if the ATC units state that there is conflicting traffic, the pilot shall not allow the parachutists to exit the aircraft, and shall circle until the controller informs the pilot that the traffic is no longer in conflict.

(D)  The pilot shall inform the ATC units if there is a planned or inadvertent high altitude parachute descent. The pilot shall circle the high altitude parachute at a safe distance and the same altitude until the parachute has descended below 5000' ASL [airspace boundary].

(E)  For free fall/parachute descents commenced below 5000' ASL [airspace boundary] the pilot shall notify [Location] ACC after take off that the parachute descent will be below 5000' ASL [airspace boundary]. The pilot shall notify [Location] Tower 2 minutes back from the parachutist’s exit point. If there is no conflicting traffic the [Location] Tower shall acknowledge that there is no conflict. If [Location] Tower does not respond, or if [Location] Tower state there is conflicting traffic, the pilot not allow the parachutists to exit the aircraft, and shall circle until the controller informs the pilot that the traffic is no longer in conflict.

Section 4 Termination:

This agreement can be cancelled by Nav Canada for non-compliance of an ATC instruction or clearance, or a breach of the above covenants.
