Special Arrangement for Approval of Configuration Deviations to Bombardier Aircraft Completion Supplemental Type Certificates Between FAA and Transport Canada Civil Aviation

The Federal Aviation Administration (FAA) and Transport Canada (TC) have agreed to a streamlined process for validation of configuration deviation approvals for Bombardier Aircraft Completion Import STCs.

Attached is a special arrangement outlining this process. Any further clarifications or revisions to this document will only be made after consultation with both authorities.

Given the local application of this procedure, the FAA and TCCA representatives below has been delegated authority to sign on behalf of their respective aviation authority.

CHAPTER 1:  GENERAL PROVISIONS

1.1  PURPOSE

The purpose of this document is to define the process by which the Federal Aviation Administration (FAA) will validate Transport Canada Civil Aviation (TCCA) deviations to the approved configuration for the completion of Business Jets interiors under Supplemental Type Certificates (STCs).  This plan has been developed as a special arrangement in accordance with Section IX of the U.S./Canada Bilateral Aviation Safety Agreement (BASA) Implementation Procedures for Airworthiness (IPA), dated June 5, 2008.

1.2  BACKGROUND

Bombardier Global and Challenger aircraft are produced and type certificated
 as “green” aircraft without a cabin interior and associated customer options.  The “aircraft completion” design is therefore certified by an STC.  Due to the high degree of customization these completions are traditionally certified in Canada by a serial number specific, Limited Supplemental Type Certificate (LSTC).  The high level of sales of these aircraft into the United States has burdened the TCCA offices and New York Aircraft Certification Office (NYACO) with repetitive data review and issuance of serialized FAA STCs, corresponding to the Canadian approvals for aircraft completions.  The procedures herein allow multiple floor plans and various customer options to be certified under a single Canadian STC (for each aircraft model) and validated in a corresponding FAA STC.

1.3  APPLICABILITY

These procedures pertain to the following Bombardier aircraft types:

  • CL-600-2B16  (604 Variant/CL605)
  • BD-100-1A10  (Challenger 300)
  • BD-700-1A10  (Global Express,)
  • BD-700-1A11  (Global 5000)

Only applications from Canadian applicants with a Design Approval Organization (DAO) who have established a history of aircraft completion approvals with the FAA NYACO under the bilateral agreement are eligible for processing under this procedure.

1.4  STC CERTIFICATION BASIS

Each Canadian Aircraft Completion STC will establish a certification basis at the initial release of the STC, which will remain unchanged throughout the life of the STC unless the design change is defined as significant under CAR 513.07/14CFR 21.101.  The certification basis would include a defined regulation level and amendment level and any additional Exemptions, Special Conditions and/or Equivalent Levels of Safety.

For significant design changes to the originally approved configuration or changes that require a new certification basis, a new or amended STC would be required.

1.5  AIRCRAFT COMPLETION MODIFICATION SCOPE

For the purposes of this procedure, an “Aircraft Completion” may consist of the following design modifications:

  • Wall, ceiling and floor coverings
  • Galley
  • Seats
  • Lavatory
  • Partitions
  • Baggage and storage areas
  • Monuments and furnishings
  • In-flight entertainment systems
  • Lighting and electrical systems
  • Emergency provisions, systems, and items
  • Non-essential communication systems
  • Water & waste systems
  • Oxygen Systems
  • External paint and markings

1.6  EXCEPTIONS TO THIS PROCESS - SPECIAL CONSIDERATIONS

Transport Canada and the FAA must certificate and validate any modification involving the following considerations.  Such cases are not eligible for streamlined processing under this procedure.

  • A modification, which requires certification by (G-1 or other) Issue Paper by either country
  • A modification, which requires an exemption to certification requirements or introduces a Special Condition
  • A modification, which represents “new or novel” technology
  • A modification, which impacts the performance limitations of the Type Certificate
  • A modification which impacts FAR 25.981 and FAR 26 compliance
  • A modification which is considered a significant change to the affected STC configuration per 14 CFR 21.101 and Order 8110.4C
  • A modification to a previously approved AFM or ICA that impact the limitations or emergency procedures.
  • A modification that impacts the required navigation and communication systems.
  • A modification that involves an acoustical change.

CHAPTER 2:  PROCEDURES

2.1  Transport Canada Civil Aviation (TCCA) Responsibilities

  1. Transport Canada will issue a Canadian STC for an “Aircraft Completion” for a Bombardier aircraft type listed in Section 1.3.  In accordance with Transport Canada policy SI 513-007, the Canadian STC will reference a Configuration Definition Record (CDR), which is a top-level document, at a specific revision level and include the words “or later Transport Canada approved revision”.
  2. Transport Canada will submit the Aircraft Completion STC to the NY ACO and the associated data package with a request for a corresponding FAA STC following bilateral procedures.
  3. For subsequent addition of a unique aircraft completion, Transport Canada will revise the CDR referenced on the STC to add approved data, which defines the unique configuration.  Each CDR revision will address only one aircraft configuration.  The revised CDR will be associated with a compliance package consisting of a Master Drawing List, Compliance Checklist, and a completed Statement of Compliance Form AE-100 or equivalent for the unique configuration.  The compliance checklist will summarize design differences from the initial STC.
  4. Transport Canada will forward the revised CDR (and associated data) to the FAA NYACO with a request that the FAA revise the FAA Aircraft Completion Import STC by reviewing and approving the revised CDR package.

2.2  FAA Responsibilities

  1. Upon receipt of a Canadian Aircraft Completion STC application, the NYACO will complete their STC validation and issue a corresponding FAA Aircraft Completion Import STC.
  2. Upon receipt of a revised CDR (and associated data package), the NYACO will review the data and indicate approval of the revised CDR via a letter to TCCA.

CHAPTER 3:  NOTIFICATION OF CHANGES TO THE CONFIGURATION DEVIATION RECORDS PROCESS

3.1  TCCA Responsibilities

If TCCA changes or terminates its configuration deviation records process, it will notify the FAA.

3.2  FAA Responsibilities Action

The FAA will consult with TCCA based on any change notification provided to determine whether revisions or termination of this procedure is necessary.
