1. Purpose

1.1  The purpose of this letter is to provide interim policy and notification of changes to External Delegations of Authority to industry.

2. Background

2.1 External Delegations of Authority were established a number of years ago to provide the aviation industry with a mechanism that allows qualified individuals, other than Civil Aviation Safety Inspectors, to issue specific Canadian Aviation Documents on behalf of the Minister of Transport.

2.2  The External Ministerial Delegation of Authority Document has been revised and signed by the Minister of Transport on February 9, 1999.

3.  Policy

3.1  The following amendments have been made to the External Ministerial Delegation of Authority Document:

Delegate titles have been changed from Airworthiness Inspection Representatives to Minister's Delegate - Maintenance and Manufacturing. Delegates in their respective disciplineswill, from this point forward, be referred to as:

Minister's Delegate -  Production  (old AIR)
Minister's Delegate -  Maintenance  (old AIR-M)
Minister's Delegate -  Recreational Aviation  (old AIR-ABA)

3.2  The following changes have yet to be made:

  1. Airworthiness Manual Chapter 505, Subchapters D, F and H and their respective Airworthiness Manual Advisories will be amended to reflect current terminology and to update their respective requirements. The proposed Subchapter G (Minister's Delegate - Maintenance) as currently contained in MPL 15, will be included into AWM 505 in due course; and
     
  2. until such time as these documents have been amended and published, the current AWM 505 Subchapters remain valid.

3.3 Current delegation (those issued previously) remain valid for the time being, however, delegates must contact their local office within 30 days of receipt of notification to receive their new documentation.

4. Issuance of new Documentation

4.1 Regional Managers shall notify all external delegates within their regional boundaries of the changes noted in this policy letter (a sample letter has been provided at Appendix A).  Except as provided in 4.2, delegates must present themselves to their Transport Canada regional office in order to receive their new Delegation of Authority credential and a copy of the amended Ministerial Delegation of Authority Document No.149545.

4.2  Alternatively, delegates can request the documentation through their local Transport Canada Centre (TCC). The delegation document, signed by the Regional Manager, shall be sent to the delegate and, once he has signed it, the delegate shall fax a copy to the Regional Manager.

4.3 The new credentials are pre-printed with the Document number [149545] and Schedule number [7]. The Regional Manager will ensure the following is adhered to:

  1. that no increase in the scope of delegation is issued to an individual who does not warrant such an increase;
  2. that the correct paragraph number is indicated on the document in the space provided. For example if the delegate is currently an AIR-ABA then he is entitled to Paragraph 2 [507.03] powers, and no other;
  3. in the case of a Minister's Delegate - Maintenance, the necessary limitations must be included. For example, indicate the kind of aircraft for which C of A and Special C of A - Restricted may be issued. This may be done either by indicating aircraft types, or by specifying general classes of aircraft, such as "Small aeroplanes AWM 523 (or equivalent design standards)", "Transport category aeroplanes AWM 525 (or equivalent design standards)", "Rotorcraft AWM 527 or AWM 529 (or equivalent design standards)", etc. (Reference MPL15 requirements); and
  4. the credentials must have both the delegate's printed name and signature on it prior to the Regional Manager signing and dating the document.

Information Note:
Initially credential cards (Form 24-0035 dated 99-02) will be provided to the regional offices in sufficient numbers to facilitate the transition. Additional cards may be obtained from the Standards and Procedures Division in Headquarters (AARPE).

5.  Effective Date

5.1  This policy comes into effect immediately.

6.  Expiry

6.1  This policy expires November 13, 2003.

Subject: Changes to Delegation of Authority

Dear Sir:

Please be advised that Transport Canada has amended certain documents that affect your Delegation of Authority as issued pursuant to Section 4.3(1) of the Aeronautics Act. These amendments and those which are yet to occur are detailed below. As a result, you are responsible for contacting and subsequently presenting yourself to your local Transport Canada regional office to receive your new Delegation of Authority credentials card and a copy of the amended Ministerial Delegation of Authority Document No.149545.

Alternatively, you can request the documentation through your local Transport Canada Centre (TCC). Regional staff must however, witness the delegate sign his name on the credentials prior to forwarding it to the regional office for the Regional Manager's signature.

Please note your current delegation remains valid for the time being, however, you must contact this office within 30 days of receipt of this notification in order to receive your new documentation.

For your information the following changes have been made:
