Other Options

In addition to the Office of Reconsideration, marine workers whose Clearances have been refused or cancelled by Transport Canada may also have the option of filing a complaint with one or more of the following organizations:

Canadian Security Intelligence Service - Security Intelligence Review Committee

If an individual believes that a Clearance was refused or cancelled because of an "act or thing" allegedly done by Canadian Security Intelligence Service, such as the collection of information or the provision of advice to Transport Canada, that individual may file a complaint with the Security Intelligence Review Committee under section 41 of the Canadian Security Intelligence Service Act. The committee does not have the authority to investigate any complaints relating to an "act or thing" done by another federal department or agency, such as Transport Canada.

Commission for Public Complaints Against the RCMP

Persons who believe that their Clearance was refused or cancelled due to the conduct of the Royal Canadian Mounted Police may file a complaint with the Commission for Public Complaints Against the RCMP . More information is available online through the Commission's website.

Federal Court

An individual may also choose to pursue the matter by way of judicial review in Federal Court. More information is available on the Federal Court website.
