This Bulletin replaces Marine Security Operations Bulletin No. 2009-001 

ISSUE

CRUISE SHIPS, PASSENGER VESSELS AND MARINE FACILITIES USING TENDERS TO TRANSFER PASSENGERS TO AND FROM SHORE.

Purpose:

To remind cruise ship and passenger vessel operators and the marine facilities that interface with them, the requirements for a cruise ship, passenger vessel and marine facility regardless of the use of tenders to transfer passengers to and from shore.

Directive:

Cruise ships and passenger vessels must comply with the Marine Transportation Security Act (MTSA) and the Marine Transportation Security Regulations (MTSR). Additionally, cruise ships must comply with the “Cruise Ship and Cruise Ship Terminal Security Measure”.

Cruise Ship and passenger vessel tenders are an extension of the Part 2 vessel, therefore, they must also comply with the MTSA, MTSR and in the case of a cruise ship, the “Cruise Ship and Cruise Ship Terminal Security Measure” to the extent appropriate to their operations.

A Cruise Ship must complete a Declaration of Security in accordance with the MTSR Part 2 section 228, which will also include the use of the Cruise Ship tender, when that Cruise Ship tender is interfacing with any marine facility (as defined by the MTSA).

A cruise ship must also continue to comply with the “Cruise Ship and Cruise Ship Terminal Security Measure” whether or not a cruise ship tender is utilised either by implementing the Measure shore side or onboard the cruise ship in accordance with the application section of the Measure.

A marine facility interfacing with a cruise ship, passenger vessel or a tender referred to above then becomes a MTSR Part 3 marine facility in accordance with the MTSR section 301 (2) and must comply with either MTSR Part 3 section 302 (2) (occasional use marine facility) or in accordance with MTSR section 302 (1).
