New Regulations Ensure Safer Practices for Cargo Vessels

OTTAWA — The Honourable Lawrence Cannon, Minister of Transport, Infrastructure and Communities, today announced new regulations that ensure safer practices for Canadian vessels carrying cargo, and for foreign vessels carrying cargo in Canadian waters.
"These regulations support the commitment of Canada's New Government to a marine industry where the health and safety of Canadians are top priorities," said Minister Cannon. "Benefits of the regulations will include improved safety, a more harmonized application of the regulations, and a decreased risk of cargo vessels from entering Canadian waters that are unsafe to load or unload."

The Cargo, Fumigation and Tackle Regulations include requirements for:

  • safe loading, unloading, and carriage of cargo for marine transportation;
  • safe fumigation practices aboard vessels; and
  • safe methods for using cargo gear, such as loading ramps and accommodation ladders.

The regulations are a consolidation of existing regulations and practices, and align themselves with international standards. They are the result of extensive consultations with the marine industry. Based on information received during the consultations, Transport Canada is confident that the industry supports these regulations.

As part of the Canada Shipping Act, 2001 (CSA 2001) regulatory reform project, the regulations will help the marine community operate in a manner that is safer, more efficient and environmentally sound. They apply to Canadian-registered vessels everywhere and to foreign vessels in Canadian waters.

The Cargo, Fumigation and Tackle Regulations were published in the Canada Gazette, Part I on December 23, 2006. A mandatory 60-day public comment period followed, which ended on February 21, 2007. The regulations were published in the Canada Gazette, Part II on June 27, 2007 and come into force at the same time as the CSA 2001.
