CONDITIONS

This Equivalency Certificate authorizes LND, Inc., to sell, offer for sale, distribute, and deliver in Canada, and authorizes any person to handle, offer for transport, transport, or import into Canada, by road or railway vehicle, by aircraft or by ship on a domestic voyage, dangerous goods in a means of containment in a manner that does not comply with subsections 5.1(1) and (2), section 5.2, subparagraphs 5.10(1)(a)(i) and 5.10(1)(b)(i), paragraph 5.10(1)(c), and subsection 5.10(2) of the Transportation of Dangerous Goods Regulations, and with columns 12 and 13 of Table 3‑1, Dangerous Goods List, Chapter 2 of Part 3 and Part 4 of the ICAO Technical Instructions for the Safe Transportation of Dangerous Goods by Air, referred to in section 12.1 of the Transportation of Dangerous Goods Regulations, if:

(a) the means of containment are non-refillable containers with a maximum operating gauge pressure of 0.021 MPa at 20 °C;

(b) the maximum internal pressure in each container at 55 °C when filled for transport is 0.035 MPa;

(c) each container is filled with Boron trifluoride, compressed, Class 2.3(8), UN1008;

CONDITIONS

(d) each container is designed and manufactured in accordance with the procedures, specifications and the drawings listed in Table 1 of Appendix A of this certificate, filed by LND, Inc., with the Transport Dangerous Goods Directorate;

(e) the container ends are welded or soldered to the container body;

(f) before filling, each container is visually inspected, proof-tested pneumatically to not less than 1.2 MPa for at least 30 seconds and shows no defect, and leak-tested using a helium mass spectrometer. The leakage rate shall be less than or equal to

10-10 cc/s;

(g) each container is transported in a strong outside packaging capable of withstanding a drop test from a height of 1.2 m without breakage of the container or of the outside packaging;

(h) a copy of this Equivalency Certificate accompanies the dangerous goods; and

(i) the shipping document that accompanies the dangerous goods includes the following information legibly and indelibly printed:

"Dangerous Goods Certificate No. SU 8810 - expiry date: August 31, 2016", or its French equivalent.

Note: The issuance of this Equivalency Certificate in no way reduces the certificate holder's responsibility to comply with any other requirements of the Transportation of Dangerous Goods Regulations and theICAO Technical Instructions for the Safe Transport of Dangerous Goods by Air not specifically addressed in this certificate.

Explanatory Note

This Equivalency Certificate authorizes the transport of means of containment described as non-refillable electron tube nuclear radiation sensors designed for use in industrial and research applications, including nuclear medical, nuclear power, health physics, non-destructive testing, and nuclear materials security. The certificate holder has demonstrated that when designed and manufactured under the conditions stipulated herein, the containers could be used with equivalent safety.

NOTE

Under Canadian Law, a foreign manufacturer of non-specification cylinders cannot be charged with an offence under the Transportation of Dangerous Goods Act, 1992 for failure to comply with the conditions of an Equivalency Certificate. However, certain remedies under the Act are available to Transport Canada in this eventuality.

These include:

1. detention of dangerous goods and consequently the means of containment containing them (subsection 17(1));

2. detention of the means of containment whether full or empty (subsection 17(1));

3. directions not to import the means of containment or to return them to origin (subsection 17(3));

4. inspectors' directions (section 19);

5. directions to importers of the means of containment to issue notices of defective construction or recall (subsection 9(2)); and

6. revocation of the certificate, thereby making any use of the means of containment an offence (subsection 31(6)).

If none of the foregoing are adequate, Protective Directions may be issued to prohibit or to control the use of the means of containment (section 32).
