Aircraft Certification Standards - Exemptions

The following table lists exemptions that have been issued by the Aircraft Certification Standards in Headquarters or that affect aircraft certification activities in Headquarters.

This table does not identify exemptions issued by a regional Aircraft Certification Office or by another Civil Aviation Branch. For information on these exemptions refer to the Exemptions to the Canadian Aviation Regulations.

The purpose of this exemption is to permit P&WC to obtain an approval for a major change to the type design that results in a re-issuance of the type certificate data sheet (TCDS) for the P&WC engine models PW127XT-M, PW127XT-N and PW127XT-L (marketing designation “PW127XT”), where the amended type design to be approved contains design features that do not comply with the applicable standards of airworthiness for the High Pressure Turbine (HPT) shaft. The proposed major change would exclude the entire HP rotor shaft system from consideration in determining the highest overspeed that would result from a complete loss of load on a turbine rotor. The proposed major change would include a HP rotor shaft system whose demonstrated design does not permit a complete showing of compliance to H3paragraph 533.27(f)(6).
In particular, this exemption is intended to provide relief from the provisions specified under this exemption to allow P&WC to field a HP rotor shaft system with safety-related improvements as compared to the presently approved design.

This exemption is intended to permit the approval of an aeroplane flight manual supplement (AFMS) containing Reduced Ground Roll – 20 Degree Flap Take-Off (RGRTO) procedures and performance data, where V1 is permitted to be an airborne speed.
The use of the RGRTO AFMS procedures and performance data allows the aeroplane to become airborne with a minimum ground roll, in order to facilitate operations on short and/or unprepared (rough/soft) surfaces, such as may be encountered when conducting flight operations from remote and sparsely settled locations.

A321-271N and A321-272N (A321neo), and models A321-271NX and A321-272NX (A321neo ACF) A-166 The purpose of this exemption is to permit Airbus to obtain an amended type certificate to include new engine option (NEO) aeroplane models A321-271N and A321-272N (A321neo models) and Airbus “Cabin-Flex” option aeroplane models A321-271NX and A321-272NX (A321neo ACF models), which contain design features that do not fully comply with the applicable standards of airworthiness for “Pressurized Cabins” in accordance with paragraphs 525.841(a)(2)(i) and (3) of the AWM [Change 525-22]. In particular, these aeroplane models contain design features that allow the cabin pressure altitude to exceed 25,000 feet for more than 2 minutes, following a decompression that results from an uncontained engine failure condition, whereby the applicable standards of the AWM are not met.  This exemption provides relief from the requirements of paragraphs AWM 525.841(a)(2)(i) and (3) [Change 525-22] for uncontained engine rotor failure (UERF) scenarios.  Approved 14960745
002-2019 17-09-2019 CAR 521.158(1) and AWM  525.807(g)(7)  AARD Airbus S.A.S.  A321-271NX and A321-272NX (A321neo ACF) A-166 The purpose of this exemption is to permit Airbus to obtain an amended type certificate to include Airbus “Cabin-Flex” option aeroplane models A321-271NX and A321-272NX (A321neo ACF models), which contain design features that do not comply with the applicable standards of airworthiness of the AWM [Change 525-23] specifying the maximum number of passenger seats permitted for all Type III exits. In particular, the proposed design exceeds the standard limit of 70 passenger seats permitted for all Type III exits, and therefore does not meet the standard.  This exemption provides partial relief from 525.807(g)(7) of the AWM [Change 525-23] by targeting exclusively the provision limiting the maximum number of passenger seats permitted for all Type III exits.  Approved 15103556
040-2018 13-09-2019 CAR 521.158(1)  and AWM 525.981(b)(2)  AARD Cascade Aerospace Inc. Bombardier DHC-8-402 A-142 Following our review, Transport Canada has determined that an exemption from AWM 525.981(b)(2) to allow approval of a change to the type design of the aeroplane model DHC-8-402 for the installation of an auxiliary fuel system, is not necessary.  Based on our review of the design proposed and the Federal Aviation Administration Notice of Proposed Rulemaking and Final Rule justification for the adoption of the amendment 25-125 to 14 CFR part 25, which is the source code for AWM 525.981, the exception in subparagraph (b)(2) is not applicable.

In consideration of the above, your request for an exemption from subsection 521.158(1) of the CARs with respect to paragraph 525.981(b)(2) of the AWM is therefore denied.

A321neo ACF aeroplane models (including any models designated as A321-2**NX) A-166 The purpose of this exemption is to permit Airbus to obtain an amended type certificate to include new A321neo ACF aeroplane models (including any models designated as A321-2**NX), which have design features that do not fully comply with the applicable standards of airworthiness for “Emergency Exit Arrangement” in accordance with paragraph 525.809(a) of the AWM [Change 525-23].  In particular, this exemption is intended to provide relief from the requirement from paragraph 525.809(a) to provide a means of viewing the likely areas of evacuee ground contact prior to opening the over-wing emergency exits. BD-700-2A12  (Global 7000)  A-177 The purpose of this exemption is to permit Bombardier to obtain an amended type certificate to include the Bombardier aeroplane model BD-700-2A12 (marketing designation “Global 7000”), where the type design to be approved contains design features that do not comply with the applicable standards of airworthiness for flight crew alerting.  In particular, this exemption is intended to provide relief until December 31, 2020 from the provisions of paragraph 525.1322(a)(2) of the AWM, to allow Bombardier additional time to incorporate a design improvement into the Engine Indicating and Crew Alerting System (EICAS).  Paragraph 525.1322(a)(2) specifies that flight crew alerts must be readily and easily detectable and intelligible by the flight crew under all foreseeable operating conditions, including conditions where multiple alerts are provided. BD-700-2A12  (Global 7000)  A-177 The purpose of this exemption is to permit Bombardier and any design approval applicant to obtain an amended type certificate or supplemental type certificate to include aeroplane model BD-700-2A12 (marketing designation “Global 7000”), which  contains design features that do not comply with the applicable standards of airworthiness, where certification for operation above 30,000 feet is requested, for the automatic presentation of oxygen dispensing units to occupants of the cabin before the cabin pressure exceeds 15,000 feet, in accordance with paragraph 525.1447(c)(1) of the AWM [Change 525-22]. In particular, and in consideration of the possibility of this aeroplane model to conduct high-altitude airport operations into airports constructed at elevations greater than 13,800 feet above sea level, this exemption is intended to provide relief from the application of the subject provision in order to prevent nuisance presentation of the oxygen dispensing units when operating at high-altitude airports. This exemption would permit the dispensing units providing the required oxygen flow to be automatically presented to the occupants before the cabin pressure altitude exceeds 17,000 feet.  Approved 14050635

The purpose of this exemption is to permit Bombardier to obtain an amended type certificate to include a new aeroplane model BD-700-2A12 (Global 7000), which contains design features that do not fully comply with the applicable standards of airworthiness for “Emergency Exit Arrangement” in accordance with paragraph 525.809(a) of the AWM [Change 525-22].  In particular, this exemption is intended to provide relief from paragraph 525.809(a) of the AWM requirements in the following three scenarios:

  • (a) in the case of the flight crew emergency overhead exit (hatch), where due to fuselage curvature the path from the exit to the ground contact point is not a straight line, a viewing means with the exit closed is not required to be capable to permit viewing of the likely areas of evacuee ground contact during all lighting conditions with the landing gear extended, as well as in all conditions of landing gear collapse;
  • (b) in the case of a non-overwing passenger exit, a viewing means with the exit closed in not required to permit viewing of the likely areas of evacuee ground contact during all lighting conditions with the landing gear in all conditions of collapse; and
  • (c) in the case of an overwing passenger exit, it is not required for a person to be able to view the likely areas of evacuee ground contact while in a position to open the exit.
