Issuance of Certificates of Service as Master and Officer of Fishing Vessels – Period of Validity of Marine Emergency Duties Training Courses

1. Policy Objective

1.1 To exempt applicants for certificates of service as master and officer of fishing vessels from complying with Section 103 (1) of the Marine Personnel Regulations (MPR).

2. Policy Statement

2.1 In order to allow applicants for certificates of service as master or officer of  fishing vessels having followed their Marine Emergency Duties (MED) training course more than five years before the application date for the certificate, to not have to submit testimonials attesting to their competent participation in emergency drills onboard fishing vessels which are exempted from holding such exercises, the period of validity of the MED training courses will not be limited to five years as set out by section 103 (1) of the MPR, for the issuance of certificates of service valid on fishing vessels.

2.2 At the same time, applicants for a certificate of service as master or officer of fishing vessels will not have to submit sea service accomplished within the five years preceding the application date in order to revalidate their competences in MED in the case where the MED training course was completed more than five years before the application date, and they will not have to produce a proof that they have completed a refresher training in MED.

3. Scope

3.1 This policy applies only to applicants for a new Certificate of service as master of a fishing vessel of less than 60 gross tonnage or a new Certificate of service as watchkeeping mate of a fishing vessel of less than 24 metres in length overall.

3.2 This policy do not apply for the renewal of the Certificates of service as master of a fishing vessel of less than 60 gross tonnage and the Certificates of service as watchkeeping mate of a fishing vessel of less than 24 metres in length overall.

4. Authority

4.1 This policy comes under the overall administrative authority of the Director General, Marine Safety and the Marine Safety Executive.

5. Responsibility

5.1 The Director, Personnel Standards and Pilotage is responsible for this policy. Regional Directors are responsible for the application of the policy.

7. Background

7.1 Section 103 (1) of the MPR requires that training courses required to obtain a certificate have been followed within the five years preceding the application date for the certificate.

7.2 When courses have been completed more than five years before the application date, section 103 (2) of the MPR allows for some equivalencies, which in the case of MED training courses, require some recent sea service along with the submission of testimonials attesting to competent participation in emergency drills.

7.3 Fishing vessels of 150 gross tonnage or less are exempted to comply with the Fire and boat drills regulations and as such, are not required to hold emergency drills.

7.5 To obtain a Certificate of service as master of a fishing vessel of less than 60 gross tonnage or a Certificate of service as watchkeeping mate of a fishing vessel of less than 24 metres in length overall, the MPR requires that applicants submit sea service accomplished before July 1st 2007 and as such, this service is not recent.

7.6 The main reason for certificates of service to exist is to recognize and grandfather applicant’s assets and during the regulatory consultation process, it was never intended to require applicants for these certificates to complete again MED training courses for the issuance of their certificate of service for fishing vessels.

8. Date of Application

8.1 This policy will enter into effect on October 1, 2011.

9. Date of Expiry

9.1 The provisions of this policy will expire when the Marine Personnel Regulations will be amended or at the latest on June 30, 2017, whichever date comes first into force.
