Temporary certificate TU 0751.2: Testing and inspection requirements

This Temporary Certificate was issued to mitigate negative impacts on stakeholders during the pandemic. The deadline to complete testing and inspection requirements is January 31, 2021 at 11:59pm (PDT).

Temporary certificate pursuant to Subsection 31(2.1) of the Transportation of Dangerous Goods Act, 1992

Certificate Number: TU 0751 (Renewal 2)

Pursuant to subsection 31(2.1) of the Transportation of Dangerous Goods Act, 1992 (TDG Act) the Minister may, in the public interest, issue a temporary certificate authorizing any activity to be carried on in a manner that does not comply with the TDG Act.

Following the declaration of a pandemic outbreak of a novel coronavirus (COVID-19) by the World Health Organization on March 11, 2020 and with the adoption of temporary measures put in place by provincial authorities, many registered Means of Containment Facilities have temporarily closed or are limiting travel for their employees who perform mobile inspections.

In my opinion, the issuance of a temporary certificate is in the public interest and I hereby authorize the handling, the offering for transport, the transport, or importation of dangerous goods in a manner that does not comply with:

  • the testing and inspection requirements of standardized means of containment prescribed by Part 5 of the TDG Regulations.

This temporary certificate is subject to the following terms and conditions:

  1. The dangerous goods are not handled, offered for transport, transported, or imported by rail tank cars;
  2. The inspection and test marks are visible and legible when they appear on the container and were valid:
    1. on February 28, 2019 in the case of cylinders, spheres, tubes, UN pressure receptacles, multiple-element gas containers, and other pressure receptacles, containing dangerous goods included in class 2.1 or class 2.2, and selected and used in accordance with CSA B340 and CSA B342, or
    2.  on February 29, 2020 for the other containers;
  3. There are no other non-compliances or safety defects with the means of containment;
  4. The means of containment is inspected and tested at the first available opportunity once inspection and test facilities resume operations; and
  5. The means of containment is not subject of any notice of defective construction or recall, or any notice of defective repair or defective testing as per Section 9 of the TDG Act.

The following definition apply in this temporary certificate:

  • “CSA B340” means CSA Standard B340, "Selection and use of cylinders, spheres, tubes, and other containers for the transportation of dangerous goods, Class 2", published by the Canadian Standards Association (CSA), as amended from time to time.
  • “CSA B342” means CSA Standard B342, "Selection and use of UN pressure receptacles, multiple-element gas containers, and other pressure receptacles for the transport of dangerous goods, Class 2", published by the Canadian Standards Association (CSA), as amended from time to time.
  • Unless the context requires otherwise, words and expressions used in this certificate have the same meaning as in section 1.4 of the TDG Regulations.

For greater certainty, this temporary certificate provides no regulatory relief other than specifically stated herein. Therefore, all other requirements of the TDG Act and the TDG Regulations apply.

This temporary certificate takes effect on September 18, 2020. It remains in effect until the earliest of:

  •  January 31, 2021, or
  • the day it is cancelled in writing by the Minister of Transport.
